Terms of Use

Last updated 21 October 2026

These terms are an agreement between you and Nexbridge Technologies (“we”, “us”) for the use of Nexbridge SmartCard (app.nexsmart.co.za). By creating an account or using the service you accept them. If you do not accept them, please do not use the service.

1. The service

Nexbridge SmartCard lets you create a digital business card and, depending on your plan, receive leads, bookings and orders through it. Features differ by plan and may change over time.

2. Your account

3. Plans and payment

Paid plans are paid either through PayFast (card or instant EFT) or by manual EFT (bank transfer) to Nexbridge Technologies, at the price shown when you buy or upgrade. For manual EFT your plan is activated once we have confirmed the payment against the reference we give you. We never see or store your card details. Prices may change; a change applies from your next billing period and we will tell you before it does.

Free trial: when we approve a new account we may give it a free trial of the Pro plan (currently 14 days). No card or payment is needed. There is one trial per person; opening extra accounts to get another trial is not allowed, and we may refuse or end a trial we believe is being misused. When the trial ends your account moves to the free plan unless you have bought a plan. Nothing is deleted, but features beyond the free plan stop and extra cards go back to draft. We will email you before the trial ends, and we may change or stop offering trials at any time.

4. Cancelling

You or we may cancel a paid plan by giving one (1) calendar month’s notice in writing; email to trevor@nexbridge.co.za is enough. Your plan stays active until the notice period ends and the fees for that period remain payable. Fees already paid are not refunded for the unused part of a billing period, except where the law requires it. After cancellation your account may move to the free plan or be closed, and paid features will stop.

5. Your content

You own the content you put on your card. You give us permission to store, display and deliver it so that we can run the service. You promise that you have the right to use it and that it does not break the law or anyone else’s rights.

6. What you may not do

We may remove content or suspend an account that breaks these rules.

7. Information from your visitors

Leads, bookings and orders sent through your card are your customers’ personal information, and you are responsible for looking after it and using it lawfully, including under POPIA. We process it for you as described in our Privacy Policy. Delete it when you no longer need it, and respond to your customers’ requests about their information.

8. Availability and backups

We work to keep the service running and make regular backups, but we cannot promise it will always be available, error-free or that nothing will ever be lost. We may carry out maintenance or change features. Keep your own copy of anything important.

9. Our responsibility

The service is provided as is. To the extent the law allows, we are not responsible for indirect or consequential loss, lost profit or lost business, and our total responsibility for any claim is limited to the fees you paid us in the three months before the claim arose. Nothing in these terms limits a right you have under the Consumer Protection Act or any other law that cannot be limited.

10. Suspension and ending

We may suspend or close an account immediately if you seriously or repeatedly break these terms or the law. You may stop using the service at any time; cancelling a paid plan follows section 4. You can ask us to delete your account and information as set out in the Privacy Policy.

11. Changes to these terms

We may update these terms. The date at the top shows the latest version. If you keep using the service after a change takes effect, you accept the new terms; if a change is significant we will tell you in advance.

12. Law and disputes

These terms are governed by the laws of South Africa. Please contact us first so we can try to resolve a problem; the South African courts have jurisdiction over any dispute we cannot settle.
